Named Holidays and Employer Designated Lieu Days
This has come up a few times this year as we have seem to have had and will have a number of Named Holidays that fall on a Saturday or Sunday. When this happens the Employer will typically assign the Monday following as the lieu day. This lieu day is not a stat however and as such does not derive the additional named holiday pay.
Full Time Employees
As many of you know when a named holiday falls on a day of rest for a full time employee they get a day in lieu loaded into their stat bank for their later use. There is language within Article 18.03(c) that outlines how this is managed.
When a full time employee is scheduled off for this lieu day essentially what is happening is that they have agreed to have the employer schedule their day in lieu on this day.
If a full time employee was scheduled to work on the designated lieu day then they would have a day loaded into their bank for later use and they would be paid at straight time for all regular hours worked.
Part Time Employees
Article 30.01 (e) - Part time receive 5% on each pay in lieu of Named Holidays and then look further down in that Article to where it amends 18.03(c) which provides for the option that when scheduled off on what would have been a regular work day as a result of a stat you are able to request to have that shift rescheduled in the shift cycle. You do have another option though … you could request that day as a vacation day if you so choose.
If you are scheduled to work the named holiday day you are paid the stat pay.
Keep in mind this is applicable to the actual named holiday day and not on what the employer has designated as the day in lieu.
If you work the day that the employer designated as the day in lieu you would be paid at straight time as that is not the actual named holiday day.
If you are scheduled off because of the designated lieu day then the employer must reschedule that shift within the shift cycle or you would also have the option to take that day as a vacation day if you so choose.
