Shift Cancellation/Reporting pay
Full Time/Part Time:
Article 7.06 of the Provincial Collective Agreement, if a Full-time or Part-time Employee reports for work as scheduled and is requested by the Employer to leave, the Employee shall be compensated for the inconvenience by a payment equal to four hours pay at the Employee’s rate of pay.
The Employee shall also be reimbursed for the cost of reasonable transportation expenses for a round trip between the worksite and their home.
If less than four hours remain in the scheduled shift, the Employee shall be paid for the remaining hours of the scheduled shift at the Employee’s rate of pay. This does not apply in situations where the start time of the scheduled shift has been changed.
If the Employer indicates that your shift is cancelled but because they have to pay you for 4 hours anyway they get you to work for those 4 hours …. This is not the correct interpretation of the language. If you were asked to work the 4 hours then you would be paid for those 4 hours and then also paid for 3.75hrs as the reporting pay for a total of 7.75hrs.
Casuals:
Under the Collective Agreement Article 30.03(a)(iv)(A) Casual Employees can only be scheduled more than seven days in advance if they are relieving another Employee for an absence of three months or less or for a specific job. Where the Employer cancels a shift after the Casual Employee has reported to work, the Employee is entitled to 4 hours pay at basic rate of pay
Similar to Full time and Part time if a casual was to arrive at work and then be told that they are only needed for the 4 hours then Article 30.03(a)(iv)(B) applies …. The employee would work the 4 hours and then receive 3.75hrs as reporting pay.
President Tip: Reporting pay is like a penalty payment for either cancelling the shift or changing the length of shift it is not the time spent working. It is not related to when you got notice unless you are being sent home immediately upon notification. Reporting pay is applicable only when you have reported to work and then notified of the change
